Unfortunately, blowing the whistle on such behavior can come with retaliation \u2014 from losing your job to being harassed or even threatened. If you have information that might reveal troubling or illegal behavior, this guide is for you.<\/p>\n<h2 id=\"whistleblowing\">What Is Whistleblowing?<\/h2>\n<p>Whistleblowing is defined as disclosing information that the person believes evidences:<\/p>\n<ul class=\"list blue two-col\">\n<li>A violation of a law, rule or regulation<\/li>\n<li>Mismanagement or any action that has an adverse effect on an organization<\/li>\n<li>Waste of funds<\/li>\n<li>Any substantial danger to public safety or health<sup><a href=\"#references\">1<\/a><\/sup>.<\/li>\n<\/ul>\n<h3>Types of Whistleblowing<\/h3>\n<p>There are several types of whistleblowing, including:<\/p>\n<ul id=\"types\">\n<li class=\"informal\">\n<h3><img decoding=\"async\" class=\"alignright size-full wp-image-20318\" src=\"\/app\/uploads\/2020\/08\/whistleblower-1.png\" alt=\"\" width=\"95\" height=\"80\" \/> Informal:<br \/>\n<span class=\"p\">Informal whistleblowing is not conducted through official channels. It can be anonymous or identified. Here are examples of both:<br \/>\n<\/span><\/h3>\n<ul>\n<li class=\"anonymous\">Anonymous\n<ul>\n<li><b>Internal:<\/b> This could be an unsigned note to a manager or an anonymous call to Human Resources within the whistleblower\u2019s organization.<\/li>\n<li><b>External:<\/b> External informal whistleblowing could entail a tip-off to a journalist or anonymous postings online.<\/li>\n<\/ul>\n<\/li>\n<li class=\"identified\">Identified\n<ul>\n<li><b>Internal:<\/b> This could mean simply discussing your concerns with a coworker.<\/li>\n<li><b>External:<\/b> External, identified whistleblowing could be something like posting about your employer on social media.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li class=\"formal\">\n<h3><img decoding=\"async\" class=\"alignright size-full wp-image-20327\" src=\"\/app\/uploads\/2020\/08\/whistleblower-2.png\" alt=\"\" width=\"88\" height=\"76\" \/> Formal:<br \/>\n<span class=\"p\">Formal whistleblowing occurs through official channels like a company\u2019s HR department or the state Attorney General\u2019s office. It can also be anonymous or identified. Here\u2019s what both look like:<\/span><\/h3>\n<ul>\n<li class=\"anonymous\">Anonymous\n<ul>\n<li><b>Internal:<\/b> This could mean leaving an anonymous message on an official whistleblower hotline.<\/li>\n<li><b>External:<\/b> External, formal and anonymous whistleblowing could be something like reporting a medication error to an official program.<\/li>\n<\/ul>\n<\/li>\n<li class=\"identified\">Identified\n<ul>\n<li><b>Internal:<\/b> Internal, identified and formal whistleblowing might mean raising concerns with your company\u2019s HR department directly.<\/li>\n<li><b>External:<\/b> If internal whistleblowing doesn\u2019t work, people may have to report concerns with a government agency or journalist<sup><a href=\"#references\">2<\/a><\/sup>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>Whistleblowing Examples<\/h3>\n<p>Whistleblowing is something that often graces our television screens and newspapers. Here are some recent examples:<\/p>\n<ul class=\"examples\">\n<li><img decoding=\"async\" class=\"aligncenter size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-3.png\" alt=\"\" width=\"69\" height=\"64\" \/><br \/>\n<h3>Edward Snowden: <span class=\"p\">Working for a defense contractor, Edward Snowden gave reporters at the Washington Post and the Guardian access to over 1.7 million classified documents revealing the National Security Agency\u2019s surveillance of everybody in the U.S. Called both a hero and a traitor by the public, Snowden now lives in exile in Russia<sup><a href=\"#references\">3<\/a><\/sup>. His whistleblowing can be classified as informal, external and identified.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"aligncenter size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-4.png\" alt=\"\" width=\"69\" height=\"64\" \/><br \/>\n<h3>Me Too movement: <span class=\"p\">Recently, there\u2019s been a ton of whistleblowing from the Me Too movement, which calls out sexual assault and discrimination against women. For example, Dr. Larry Nassar, formerly a physician for the U.S women\u2019s gymnastics team, has been accused of molesting and sexually assaulting women since 1998, when a student-athlete at his then-employer Michigan State University first reported him; the university didn\u2019t take any action. After several accusations, a federal, class action lawsuit, and the coming forward of three Olympic athletes, McKayla Maroney, Aly Raisman and Gabby Douglas, Nassar was finally sentenced to 40 to 125 years in prison in 2018, 20 years after the first accusation. In this case, the whistleblowing was at times both anonymous and identified, formal and informal, and internal and external, given the amount of times Nassar was accused of sexual misconduct<sup><a href=\"#references\">4<\/a><\/sup>.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"aligncenter size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-5.png\" alt=\"\" width=\"69\" height=\"64\" \/><br \/>\n<h3>Black Lives Matter movement: <span class=\"p\">Finally, the Black Lives Matter (BLM) movement against police brutality has done a fair amount of whistleblowing regarding the murders of Tamir Rice, George Floyd and other unarmed black people. BLM has also called out racism in institutions like the Los Angeles Times. Angel Jennings, the newspaper\u2019s only black reporter in local news plus six other journalists, sued the LA Times and its publisher, Tribune Publishing, for their pay gaps compared to their white colleagues, saying it violated California\u2019s Equal Pay Act; they later reached a settlement<sup><a href=\"#references\">5<\/a><\/sup>. This is an example of formal, identified and external whistleblowing.<\/span><\/h3>\n<\/li>\n<\/ul>\n<h3>Consequences of Whistleblowing<\/h3>\n<p>Although there are measures in place to prevent retaliation, whistleblowers often face consequences for coming forward with sensitive information. According to the U.S Department of Labor<sup><a href=\"#references\">6<\/a><\/sup>, here are some possible challenges that whistleblowers could face after the fact:<\/p>\n<ul class=\"list two-col\">\n<li><b>Retaliation<\/b>\n<ul class=\"arrow two-col\">\n<li>Being fired, laid off or demoted<\/li>\n<li>Denied overtime or a promotion<\/li>\n<li>Disciplined<\/li>\n<li>Denied benefits<\/li>\n<li>Reducing pay or hours<\/li>\n<li>Failing to rehire or hire<\/li>\n<\/ul>\n<\/li>\n<li><b>Intimidation, harassment or threats<\/b><\/li>\n<li><b>Social isolation or ostracization<\/b><\/li>\n<li><b>Blacklisting<\/b><\/li>\n<\/ul>\n<h2 id=\"resources\">Resources on Whistleblowing and Protecting Whistleblowers<\/h2>\n<p>While federal and most state laws prohibit retaliation against whistleblowers, it\u2019s still best to take steps to protect yourselves, a colleague or even a journalistic source.<\/p>\n<h3>How To Protect Yourself as a Whistleblower<\/h3>\n<p>Before you whistleblow, make sure you have a plan to protect yourself. Our tips:<\/p>\n<ul class=\"tips\">\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-6.png\" alt=\"\" width=\"83\" height=\"83\" \/><br \/>\n<h3>Read the law: <span class=\"p\">First find out if you have engaged in \u201cprotected activity\u201d according to your state laws, detailed below. \u201cProtected activity\u201d means that the whistleblower reports or refuses to engage in violations of regulations, laws or rules. Not all whistleblowing is protected equally; rather, the laws vary based on the industry, agency, city, state and more.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-7.png\" alt=\"\" width=\"83\" height=\"83\" \/><br \/>\n<h3>Remain anonymous: <span class=\"p\">The best way to avoid retaliation is to remain anonymous throughout the whistleblowing process. You can do this by reporting to the Securities and Exchange Commission, Commodity Futures Trading Commission and the Internal Revenue Service, all government agencies that will conceal your identity.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-8.png\" alt=\"\" width=\"83\" height=\"83\" \/><br \/>\n<h3>Know the statute of limitations: <span class=\"p\">Different states have different statutes of limitations on the amount of time you have after employee retaliation to create a civil suit. Know that time frame beforehand in case you\u2019re retaliated against. For example, in Florida, whistleblowers have 180 days after receiving a notice from the Florida Commission on Human Relations that they received their complaint to file a civil suit actionst their employer for retaliation. However, Rode Islands have three years after the retaliation to bring civil action against their employer, so the range varies pretty greatly. To learn more, read about your state\u2019s whistleblowing laws below.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-9.png\" alt=\"\" width=\"83\" height=\"83\" \/><br \/>\n<h3>Keep the receipts: <span class=\"p\">Gather as much hard evidence of the violations as possible. Audio recordings are the most useful; however, not all states allow recording of people without their consent, so make sure to look that up beforehand in a guide of state recording laws<sup><a href=\"#references\">7<\/a><\/sup>. If audio recording isn\u2019t allowed, keep detailed notes of both the wrongdoings and any relations you might face. Store them privately, and especially not at your workplace<sup><a href=\"#references\">8<\/a><\/sup>.<\/span><\/h3>\n<\/li>\n<li class=\"full\"><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-10.png\" alt=\"\" width=\"83\" height=\"83\" \/><br \/>\n<h3>Get help: <span class=\"p\">There are a number of whistleblowing organizations that offer free legal assistance to whistleblowers. Our favorites include:<\/span><\/h3>\n<ul class=\"list three-col\">\n<li><b>Government Accountability Project: <\/b>This non-profit organization has helped over 8,000 whistleblowers since 1977, taking on wrongdoings by corporations, government agencies, financial institutions and more<sup><a href=\"#references\">9<\/a><\/sup>.<\/li>\n<li><b>Whistleblower Aid: <\/b>Finally, Whistleblower Aid is another non-profit providing whistleblowers with free legal aid, although they may take a portion of any monetary award from a retaliation civil suit<sup><a href=\"#references\">11<\/a><\/sup>.<\/li>\n<li><b>National Whistleblower Center: <\/b>The National Whistleblowing Center provides information, legal assistance and advocacy for whistleblowers<sup><a href=\"#references\">10<\/a><\/sup>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>Best Digital Practices for Whistleblowing<\/h3>\n<p>Aside from protecting yourself from employers and the law, there are a few ways you can make sure that your information and identity stay safe, as well. After all, anonymity is the best way to protect yourself as a whistleblower. Here\u2019s what we recommend to retain your digital security:<\/p>\n<ul class=\"tips\">\n<li><img decoding=\"async\" class=\"alignleft size-full wp-image-20321\" src=\"\/app\/uploads\/2020\/08\/whistleblower-11.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Don\u2019t use your work phone: <span class=\"p\">To protect your anonymity, use your home phone as opposed to the phone in your office or organization. Kathleen McClellan, National Security and Human Rights Deputy Director for the Whistleblower and Source Protection Program at ExposeFacts<sup><a href=\"#references\">12<\/a><\/sup>, says that it\u2019s unlikely that corporations or government agencies will monitor home devices, unless you work for the NSA, CIA or FBI, in which case avoiding home surveillance may be next to impossible.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-12.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Don\u2019t work on your home or work Internet: <span class=\"p\">If you\u2019re using your home device on a public Wi-Fi network like at a coffee shop, use <a href=\"\/vpn\/best\/\">a VPN<\/a>, or Virtual Private Network. VPNs <a href=\"\/vpn\/hide-your-ip-address\/\">hide your web traffic and IP address<\/a>, encrypting your activity.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-13.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Create accounts with fake names: <span class=\"p\">For any email, social media or messaging apps you may be using to communicate about your whistleblowing, create new accounts with fake information.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-14.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Stay on task: <span class=\"p\">When you\u2019re working on your whistleblowing by using the Internet at all, make sure you don\u2019t do other online activities simultaneously, like checking your email or shopping online.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-15.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Use <a href=\"\/vpn\/browsing-history\/\">a secure browser<\/a>: <span class=\"p\">We recommend using Tor<sup><a href=\"#references\">13 <\/a><\/sup>instead of your regular web browser, as it lets users remain anonymous.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-16.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Use encrypted messaging apps: <span class=\"p\">Instead of using your phone\u2019s default messaging app like iMessage, use an encrypted app like TextSecure<sup><a href=\"#references\">14<\/a><\/sup>.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-17.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Check phone settings: <span class=\"p\">You may not know this, but your phone is most likely tracking you at all times. Here\u2019s how to change your settings:<\/span><\/h3>\n<ul class=\"list\">\n<li><b>iOS:<\/b> Under Settings, click on Bluetooth and toggle the switch off. Next under Settings, go to Privacy then Location Services and toggle the switch to off.<\/li>\n<li><b>Android:<\/b> In Settings, click Connected Devices, Connection Preferences, then Bluetooth and turn it off. Also in Settings click on Google, Manage Your Google Account, Data and Personalization then Activity Controls and turn it off.<\/li>\n<\/ul>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-18.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Hide your screen: <span class=\"p\">Hacking isn\u2019t the only way that <a href=\"\/identity-theft\/\">people can get your credentials<\/a>; they can also do it the old-fashioned way by peaking over your screen<sup><a href=\"#references\">15<\/a><\/sup>. To hide your web activity in a flash, you\u2019ll need to know the device\u2019s keyboard shortcut you can press to hide your web windows or tabs. Here are the shortcuts for the most popular computer brands:<\/span><\/h3>\n<ul class=\"list three-col\">\n<li><b>Mac:<\/b> Command-H<sup><a href=\"#references\">16<\/a><\/sup><\/li>\n<li><b>Windows:<\/b> Windows + D<sup><a href=\"#references\">17<\/a><\/sup><\/li>\n<li><b>Chromebook:<\/b> Shift + Ctrl + w<sup><a href=\"#references\">18<\/a><\/sup><\/li>\n<li><b>Dell:<\/b> Alt + Q<sup><a href=\"#references\">19<\/a><\/sup><\/li>\n<li><b>HP:<\/b> Alt + F4<sup><a href=\"#references\">20<\/a><\/sup><\/li>\n<li><b>Lenovo:<\/b> Ctrl-W<sup><a href=\"#references\">21<\/a><\/sup><\/li>\n<\/ul>\n<\/li>\n<li class=\"full\"><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-19.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Close accounts on public computers: <span class=\"p\">If you\u2019re using a public computer, make sure to completely log out of your accounts and remove any devices or software that you used on it.<\/span><\/h3>\n<\/li>\n<\/ul>\n<h3>How Journalists Can Protect Whistleblowers<\/h3>\n<p>Oftentimes, whistleblowers will turn to journalists as a last resort after being ignored by their employer or a government agency. But in going public with an accusation of wrongdoing, whistleblowers put themselves even more at risk. Here\u2019s how to make sure your source stays safe:<\/p>\n<ul class=\"tips\">\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-20.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Use anonymous sources: <span class=\"p\">The easiest way to protect the whistleblower\u2019s identity is to not reveal their identity both in your reporting and even to government requests. Of course, journalists should only use anonymous sources in the event that the whistleblower faces real danger or retaliation and if they can\u2019t get this information elsewhere. We recommend consulting a lawyer before going public with a story.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-21.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Use best digital security practices: <span class=\"p\">Just as whistleblowers protect themselves digitally, journalists should use the same digital security tactics<sup><a href=\"#references\">22<\/a><\/sup>; see above for more information.<\/span><\/h3>\n<\/li>\n<\/ul>\n<h3>How Businesses Can Protect Whistleblowers<\/h3>\n<p>Businesses and whistleblower employees don\u2019t have to be at odds with each other. Rather, businesses should create environments where whistleblowing is encouraged and where whistleblowers are protected. Senior leadership must be dedicated to transparency, accountability and an anti-retaliation approach, which may include:<\/p>\n<ul class=\"tips\">\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-22.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Create a \u201cspeak up\u201d culture: <span class=\"p\">Aimed at preventing wrongdoings before they occur, a true \u201cspeak up\u201d culture encourages employees to raise issues, knowing that they\u2019ll be resolved fairly.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-23.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Make a resolution system: <span class=\"p\">You should create a system for resolving reported violations that protects the whistleblower.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-24.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Train workers on their rights: <span class=\"p\">Tell your employees their rights when it comes to whistleblowing, including information on internal and external protection programs. Make sure managers are trained as well.<\/span><\/h3>\n<\/li>\n<li><img decoding=\"async\" class=\"alignleft size-full\" src=\"\/app\/uploads\/2020\/08\/whistleblower-25.png\" alt=\"\" width=\"77\" height=\"78\" \/><br \/>\n<h3>Use an independent auditor: <span class=\"p\">To determine if your protection program is effective, we recommend hiring an independent auditor<sup><a href=\"#references\">23<\/a><\/sup>.<\/span><\/h3>\n<\/li>\n<\/ul>\n<h2 id=\"laws\">Laws About Whistleblowing<\/h2>\n<p>The good news is that whistleblowing is legal in the United States and is protected by dozens of federal, state and even local laws. However, every law has its own respondents, meaning who it covers, as well as stipulations, so again, it\u2019s important to research the legalities before you whistleblow. Your best bet is to contact a lawyer directly, but we outlined the main laws below.<\/p>\n<h3>Federal Whistleblowing Laws<\/h3>\n<p>The federal government has several regulations that protect employees from retaliation for whistleblowing; however, not every law protects every employee in the U.S. Let\u2019s take a closer look.<\/p>\n<ul class=\"laws\">\n<li><b>Whistleblower Protection Act:<\/b> This act applies to federal employees and applicants only, protecting them from employer retaliation.<\/li>\n<li><b>Whistleblower Protection Enhancement Act: <\/b>This act strengthens protections for whistleblower federal employees<sup><a href=\"#references\">24<\/a><\/sup>.<\/li>\n<li><b>False Claims Act: <\/b>Covering private citizens, the False Claims Act says that anyone can file suit on behalf of the government if someone has filed false claims. If there\u2019s a recovery of funds, the private citizen could receive a portion<sup><a href=\"#references\">25<\/a><\/sup>.<\/li>\n<li><b>Dodd-Frank Act: <\/b>Among other things, the Dodd-Frank Act establishes a whistleblower program that requires the Commodity Futures Trading Commission to pay eligible whistleblowers who provided information about violations of the Council of Economic Advisers which resulted in the successful enforcement of a covered administrative or judicial action. This act also protects the whistleblowers from retaliation<sup><a href=\"#references\">26<\/a><\/sup>.<\/li>\n<li><b>IRS\u2019 Whistleblower Law: <\/b>This law says that whistleblowers that report people who don\u2019t pay their owed taxes should be rewarded for up to 30 percent of the remaining tax, penalties and other collected amounts<sup><a href=\"#references\">27<\/a><\/sup>.<\/li>\n<li><b>Taxpayer First Act: <\/b>This act creates reforms for whistleblowers who report to the Internal Revenue Service specifically.
